Senate Republicans seek federal activation for New York prison guard troops

New York State Senator Joseph Griffo and his fellow Senate Republicans have formally requested federal activation of the National Guard troops deployed in New York’s correctional facilities. In a letter addressed to President Donald Trump and General Steven S. Nordhaus, Chief of the National Guard Bureau, they are seeking this action under Title 10 of the United States Code.

This move would ensure that the Guard members receive benefits and legal protections equivalent to those of active military personnel. Currently serving under state orders, these troops do not qualify for certain federal benefits. The proposed change would grant them comprehensive health coverage and potentially authorize continuing care through the VA by assigning a disability rating.

The letter states: “We respectfully request you as Commander-in-Chief of the National Guard, federally activate the National Guard members currently serving in the State’s correctional facilities, under Title 10 of the United States Code.” It further emphasizes that “the benefits under Title 10 include comprehensive healthcare coverage,” which is deemed essential due to challenging conditions faced by many Guard members.

The deployment of over 6,500 New York Guard members came after correction officers began striking at multiple prisons across the state in mid-February. Governor Kathy Hochul ordered their deployment to maintain order amidst reports indicating unsafe and unsanitary working conditions for these troops.
